Criminal Law Questions!!?

Postby egan » Thu Nov 24, 2011 3:42 am

A woman that followed her boyfriend from City 1(the city they live in) into City 2 that is in TWO different counties. Then she waits till her boyfriend go inside a motel with a woman and slashes all four of his tires that cost about $200 total because they were used. She then took the key for the room her bf is in off of the key cabinet when the clerk wasn’t there. She then went to the room and threw a lamp and almost hit the girl. She slapped her boyfriend. What are all of the crimes she committed?? Is this a city/state/federal crime? What charges could she be facing? Which venue has jurisdiction? Where will the case be tried? City 1 or City 2?

Stalking; harassment, property damage to the tires (possible felony if it disabled the vehicle), possession of a dangerous weapon (if she used a knife to commit a crime), theft of the room key from the motel clerk (would be robbery if she took it under threat of force), burglary ("breaking and entering" with intent to commit a crime inside, where the "breaking" consisted of the unauthorized opening of the door using the stolen key), assault and battery on the bf, attempted assault on gf. These are all crimes under state laws of the place where the crimes were committed. The trial (which is somewhat rare) would be held in City2, where the crimes occurred, unless there is some good reason that the case should be dealt with in another venue (i.e., corrupted jury pool, lack of disinterested judges, etc).

Not working in law enforcement, but I got an "A+" in criminal law in law school. Studied laws since 1968, when I was a safety-patrol officer.

Criminal Law Questions!!?

I don't know for sure, but I'm thinking about the Natalie Holloway case which took place in Aruba. At the time, the state of Alabama and her parents were hoping to find the killer in Aruba, then have the trail moved to the United States--I don't think that's possible. However for them, the killer was found in Peru, where he attempted "similar" action with a female. Peru held him and put him to trail. I suppose after his sentencing which is about 25 years, Aruba can step in and he then gets charged for the Holloway murder.

It's just interesting how bouncing city to city sort of confuses things.
