Custodial Grandmother Wishes To Reverse Custody In Tn.

Postby osryd » Fri Dec 13, 2013 8:38 pm

I am custodial grandmother of two girls aged three and 12, who had been location in my care two years ago when their mother was on drugs and putting them in danger. She has been sober now two years and on the appropriate path, total time student and full time job. At this time we are questioning what the subsequent step would be in attempting to phase her custody back to her. She resides in the precise very same state (Tn) as we do, but a diverse city. The oldest granddaughter is there for the summer time and we are pondering about letting her be enrolled in that city as an option of Memphis and letting her maintain with her mother. We nevertheless have the grandbaby and intend on moving to that neighborhood in the close to future to aid with the whole transitioin. We see wonderful improvement in mother's behavior and commitment to sobriety, and we would like to give her youngsters back. Does she have to appeal the court or can we just have it reversed? Just some support in what to do 1st at this point would be superb.
Thanks....Deb Obrien

Unless the order granting you guardianship/custody over the youngsters says you specifically have to ask the court's permission prior to, say, you let a single of the youngsters go reside with her, clearly you happen to be cost-free of charge to let that take place and sign whatever document a college would demand to see ahead of it allowed the mother to enroll a kid in school there.  Not clear what you mean by "can we just have it reversed," but if a court rubber-stamped/authorized a guardianship/custody formally and you want to no longer be the legal guardian, naturally she or you would demand to petition the court to that impact.  I do not see it acquiring complicated if each and every of you agree, whereas of course if it had been a matter of you disagreeing, she'd have to jump by implies of far a lot more hoops.  Of course, you do not mention whether or not or not the state children's protective options have been involved in all this and regardless of no matter whether there had been other court orders relating to her obtaining to do X-Y-Z.One particular specific or every single of you need to have to seek tips from with a neighborhood household law attorney to the court that issued the order.

It has to take place in the county where the children have been living. I imagine either party could file.

Thank you, that is what I thought.
One other thing, does she need to start the appeal process in the same county as it was ordered in, or can she do it in her current county? Or.... do I need to start the process?
