Divorce in kentucky.?

Postby philibert63 » Mon Oct 31, 2011 5:07 pm

Does anyone know divorce laws in ky? If you have to split everything (house, money cars ect) between the two does this include one of the spouses 401k.?
My mother wants a divorce from this abusive/glambing/alcoholic husband of hers. She took care of him for 2 or 3 years while he got on disability for his back. He now draws about 2k a month in disability. He sold his house and moved in to hers. He paid off the rest of the house which was around 12k. She had been paying on it for years b4. It is in her name. He does not pay any bills other than 300 insurance. she pays the rest and buys his beer and cigarettes and gas. He doesnt pay for groceries or anything either.
He doesnt pay any bills(electric, gas, water, phone, internet, trash..ect) he spends all his money on gambling and paying for his grown sons 4wheeler payments. This is not my moms child.
He says if she wants a divorce he wants his 12k for the house back and her cars which she paid for. and he wants money for the labor where he remodled her bathroom( she paid for all materials). Since she has been taking care of him for the last 5 years with him paying no bills, i dont think he should get any 12k or and money back... but if it is all split wouldnt that mean she is entitled to his 401k whick is over 100k?
Thanks.

What we think and what the laws are end up being 2 different things. If he can ask for his 12k then your mom has ever right to ask for that 401k. You two get creative, tell him she can ask for support from him on his disability. Who cares let him be the one to get upset.
A lot of attorneys have a free first time consult to answer your questions. See if the court that you would go to has a website, some have free information about the laws.
Too many times people get caught up in the emotions of the proceedings, but trust me, to win you have to turn off the emotions and go for it if that is what you want. Turn into someone that doesn't care and you will come out on top.
