 I want some support. I moved to Nevada 08/08/2011 filed for divorce 01/03/2012 I have the young children. He filed for divorce in Idaho 01/26/2012. He claims Idaho has juristiction more than young children. I don't know what to do to maintain my case in Nevada.

The worst happen. I dropped legislation of my children in their State of Nevada my predicament got transferred to Idaho exactly where he stuffed. How do I answer his situation? How to proceed next? I do not understand what to full. I do not wish to transferred to California. All of the support is probably to be appreciate.

You'd need a Identification attorney to file a response within the divorce action there stating that NV law simply requires you to be always a citizen in NV for in my opinion six days (vs. months) before being ready to file for divorce there.  I do not know whether NV law requires the children to have existed there an extended time period before NV might have authority within the problem of custody and so on; for that problem, you both need to examine NV family law laws or talk to an NV lawyer.   If you do not file an opposition/response to the Identification processing inside the required time period permitted, you might find yourself needing to cope with ID.

This is one of the repercussions for leaving the state with kids. Dad can argue that the kids have not been in NV long enough and his state may have jurisdiction. Is Dad asking for custody or the kids be returned?

Vegas ResidencyPrior to receiving a divorce in Nevada, among the divorcing parties should create Vegas residency. Including surviving in their State of Nevada for at-least six (6) months before the beginning of any divorce proceeding. A person should have the intention to permanently live in their State of Nevada at that time the divorce action is submitted. Residency means having a bodily existence in Vegas though a person wouldn't be precluded from operating beyond your State while he or she's creating residency, so long as he or she's really physically surviving in the State.To confirm residency, an Affidavit of Resident Experience is needed to be submitted in a divorce planning. This Affidavit is performed by way of a Nevada resident; who has been a Nevada resident for at least twelve (12) months and who may state under oath that they're familiar with the individual seeking the divorce and individually understand that individual has existed within the State-Of Nevada at least six (6) days before the beginning of the divorce action.From:  http://www.divorcesource.com/NV/POSTS/roullard1.html
If your days are appropriate, in my opinion that you might have overcome him towards the punch.  Allow your NV lawyer manage it and do not examine with STBX.

A short google search suggestst that the kids would want to have been citizens of NV for six months (not six days) so as for NV to have jurisdiciton within the custody problem.
NV may divorce you. You yourself have been there long enough. Certainly lots of people do visit NV to divorce due to the status for "a quickie" divorce. That is good when you yourself have no kids and no actual marital home to separate.
But, if your spouse really wants to claim that Identification has authority within the custody problem, he may get that one. Your kids haven't been NV citizens long enough.
The longer residency requirement of the children seems to be section of a NVis reaction to a Nationwide regulation demanding that in order to prevent forum-shopping on custody/support cases.

You might have to ask yourself whether it's useful togo through using the NV motion and spend a NV lawyer, if you can't determine it out for yourself and the one thing that you'd get is standing of the solitary person. Your NV lawyer might not have the ability to represent you in Identification, until he's certified in both claims.
Therefore, you can well find yourself with two sets of court expenses, two sets of lawyer fees and invest plenty of additional time working with two legitimate grievances.
If your initial consult a NV lawyer does make sure NV can't choose the kid custody problem, you might would like to ignore the NV criticism. Subsequently, employ a lawyer in Identification to deal with all your divorce associated issues.
