I want to take someone to small claims court because we had an agreement about an apartment I wanted to move into and then he took another tenant that could pay more. we were moving from another city, so we mailed the deposit and lease to him, so we did not get it signed from him yet. In the mean time, he got the other tenant. He stated in multiple emails that is was ours as long as we sent him the deposit. WIll those emails hold up in court. I don't want the apartment at this time, but we did turn down other apartments thinking we had this one and now have to take another trip to Pittsburgh to find a place. Between hotel and flights (not including food) it cost up about $1000 last time.

If a law on electronic evidence has already been enacted in Pennsylvania, then the emails referred to in your question can be admissible as evidence in Court. However, if you mailed the deposit and the lease documents, the postal receipt is sufficient proof and there is a binding agreement between you for the apartment. A verbal agreement is binding between the parties thereto even if it is not reduced to writing.
