The Federal government has a patent for medical marijuana. The Federal government has a patent for medical marijuana, but tobacco companies don't have any marijuana patents. Marijuana itself can't be patented because it is a plant, but in a pre-emptive effort, the government has claimed the patent for medical marijuana, should it ever become legal. Typically, companies can't get patents for items that they cannot legally produce, so as of right now, no tobacco company can patent the marijuana cigarette. It is possible that tobacco companies in other countries have a marijuana cigarette patent since marijuana is legal in many other nations.
