Do they have a claim?

Postby leonie36 » Fri Apr 01, 2011 1:28 pm

accident at fault- everyone said they were fine when ambulance was called, other party had no time off work, has not sought medical attention and never attended hospital regarding matter. but afterwards said they were hurt i.e tissue damage and are claiming against my insurance.

most personal injury claims these days are simply people who are digging for gold, and im sure this is.

what are the chances of success with the facts above? (UK)

Do they have a claim?

Sounds like they have been approached by a 'no win no fee ' claims company, this is one reason car insurance is so high in the UK, without any medical evidence I can't see any claim succeeding.

Do they have a claim?

Chances? Unless someone here has a crystal ball they can gaze into and foretell the future, I guess you will have to wait and see. Why worry? Your own insurance is well equipped to spot fraud. Have you reported this accident to them as you are required to do?

Do they have a claim?

The next time you are out driving, look at all the billboards of lawyers asking if you were injured in an accident to call them to represent you. Or on TV, the commercials for lawyers stating if in an accident and injured, to call them.

There is a saying in the insurance industry that when a person is injured in an accident, they think they hit the lottery.

Since they have filed a claim on your insurance policy, the job of the adjuster handling the claim will determine if they are injured or not. It is not uncommon that at the scene of an accident that many people will claim they are ok, but later that evening or the next morning awake sore and then seek treatment. If so, then they will have medical reports from the ER or doctor stating that due to this accident were injured and sought treatment.

Don't worry about it, since your insurance will handle and pay if you owe, or deny if they believe not owed. They are trained to spot fraud or legitimate claims.

good luck
