Do you have to give someone 30 days to move out?

Postby ern » Mon Jul 23, 2012 6:31 am

So, in the perspective of my grandmother. Her daughter-in-law has lived inside of her house for more than 16 years. She does not pay rent, and she is not under any kind of contract or what not. Does my grandmother legally need to give her 30 days to move out? Or is that just in the case of land lords?

Better to do this through the court system as a legal eviction. Then there are no doubts.

Legally yes, if she receives mail at that address she has astablished residecy there. Just formally evict her and give her the thirty days once the thirty days is up she is then squating and she can be labled as an a intruder, and you could call the police, or if she leaves her stuff after the thirty days throw everything to the curb.

Depends on the laws where she lives, and could even be longer, but it's 30 days most places to evict someone legally if they've been living there, whether they paid rent or not.

You are required to give tenants that PAY rent by the month...30 days notice.
It would be kind to give her 30 days..unless some disagreement between the two have made it
stressful for your grandmother to allow her to remain any longer.
If that is the case...she can send her packing this afternoon with no further worries.
If the daughter-in-law is the type to get angry and start doing damage to anything...help to get her packed and out as soon as possible.
You might want to be there during the process, to support your grandmother and afterwards if you
can,in case she comes back.Make sure she has everything she owns,so there is no reason to
return.No storing extras for her.

No because her daughter in law is not a paying tenant. She is a resident.
