I'm 18 years old and i donated plasma for awhile for a little extra cash. Last time i went to donate (4/25) one of the workers stuck my arm wrong and the needle went through the vein and started to pump blood into my arm instead of the vein. I felt a lot of pressure in my arm and the workers came by and pulled the needle out of my arm a little bit so it wouldn't still be stuck through. on 4/30 i went to the emergency room (because i don't have insurance) under the advice of the plasma center. My arm was severely bruised and i couldn't even outstretch my arm all the way. they said it was infected with Phlebitis and prescribed me an antibiotic and an anti-inflammatory. The NP (pretty much doctor) wrote and signed a note saying that the plasma center was at fault. i asked the plasma center to pay for my prescriptions and the first person said no, so i left, thought about it and came back and demanded them pay for my prescriptions. They said they could reimburse me after i payed for them. i could only afford the antibiotic so that's what i got. the other prescription cost $22.78 and i couldn't afford it. as of now i have not accepted any compensation or reimbursement from them. I am thinking about consulting a personal injury lawyer on monday and would like to know if i have a case or would just be wasting my time. thanks!

Remember you signed a waver before giving and getting paid.

I would need to know if you signed any sort of form prior to donating ever. If you did it more than likely stated that they would not be liable for any inury. Iif not, you could have a case and I would contact a lawyer if you are that desperate for reimbursment. More than likely, if it is just for the medicine, it would cost you more for a lawyer than it would be worth to get the money for the perscriptions.

You do have a case because of the jury. If you do not have full function of your arm, then you have a injury case, but not a hospital compensation case. You have to decide if you want to sue for the injury or the hospital bill and antibiotics. Technically I don't know how someone could have the lively of using their arm after being bludgeon with a needle and infected with Phlebitis

call a lawyer or go to a website that has legal advice, like http://www.freeadvice.com/. either way they will let you know if you have something to move forward with or not.
