What happens in a car accident settlement case?

Postby anglesey34 » Mon Nov 21, 2011 9:40 pm

I was in a car accident two weeks ago. The other driver was in fault and he rear ended me pretty bad. My neck and lower back hurts really bad and I have trouble sleeping. I have to wear a neck brace for six weeks. I got a lawyer that specializes in auto accidents. He took the case immediately and told me to seek physical therapy. The physical therapist that I go to only takes patients with lawyers that have been in an accident. They told me to come everyday and I told them I can only come twice a week which I think is good. Then they said three times a week. I'm covered by no fault for my doctor visits but something about this seems shady to me. Like only taking patients with lawyers and being persistent about coming every day for therapy. Also a friend of mine was in the same EXACT situation as me. The only difference was it happened on the job. She's a taxi driver. She had a no fault case too and her bills were covered. She said she did not want worker's compensation because she works off the books. They said she had to get worker's comp and refused to see her. Why should it matter as long as they get paid through the insurance company?

When you have a settlement do the doctors get a percentage especially the more visits you have? How does this work? I thought the docs and therapist are ONLY paid for the visits and the lawyer gets 33% of the settlement. I'm confused please help.

In order to get the maximum compensation you must follow the advice of the professionals. The doctor is certified, your physical therapist is licensed. Everyone gets a piece of the pie. The longer you stay in treatment the larger the fees. The larger the fees, the larger are the monetary gains for all, and it's all legal. If you trust your lawyer and his associates, follow there directives. You can't judge your case by someone else's. You don't know all of their circumstances.

The disposition of the money will vary greatly depending on a multitude of factors. If you settle the case before it goes to court then you would decide who gets what, if it goes to court and there is only enough to cover half the expenses then the judge decides who gets what, some may get nothing at all. If there is enough to pay everybody then everybody gets everything they billed for, in this case the more often you go to the docs the more money they make because they bill on a per visit basis.
