Can i get a settlement?

Postby wal49 » Tue Jul 03, 2012 12:36 am

At work i hit a car on a motorized scooter. i tried stopping but the car was right in front of me and i hit the back left side and t-boned him. he was doing twenty mph and i was doing 20 also. I flipped and went to a hospital. The xrays said i have nothing wrong, but i got 4 butterfly stitches in my elbow, my elbow is really banged up and alot of skin is missing. i got a tetnis shot. My finger is really swollen. My back has a huge bruise and is scraped up also. The accident may hve been my fault since i tboned him. We both did not have a stop sign, it was in a parking lot. The hospital gave me workers compensation forms and said that my work will cover it. Can i get a settlement or any compensation for this accident?

Either you can have your employers workers comp policy pay for your personal medical bills and lost wages, or you can sue and maybe win a small award.

You don't have any reason why anyone should give you a settlement; you were at fault.

When you say a settlement do you mean can you sue for compensation? Let's see, the doctor said you have nothing wrong, you were not hospitalized, you apparently didn't miss even a day of work, workers compensation is going to pay the medical bills and if that isn't enough you suggest yourself that you "may have been at fault" for the accident.

If you are the negligent party and there is no loss what would this "settlement" be compensating you for?

Take the Workman's comp and be more careful in the parking lot, you could have been hurt allot worse.
