Do you trademark a name or the actually logo with the name?

Postby troyes » Tue Jul 31, 2012 9:16 pm

Hi

I am starting a new publication, with a name similar to ' Pocket Restaurant Guide ', can I trademark that name, or only the logo I have for it (that's not exactly the name but its along those lines) ?

Its really the name I need, but looking at IPO its seems to be more the visual representation on the name rather than the name itself?

Any advice in this area would be great. I have visited the IPO website but its both specific and vague if that makes sense.

I appreciate the help.

Ashley

You trademark the name because it is text and copyright the logo as it is an image.

"It can be for example words, logos or a combination of both."
Since you already have the answer, why did you ask the question?

Your problem might be that the name is considered too general to be copyrighted - so it would be the logo and format of the words which would be distinctive. A quick Google search throws up quite a few references - you might find you need to be geographically specific to copyright a name for your magazine.
