Does anyone know if this is Wrongful interference with my Employment?

Postby westbroc90 » Sat Jul 21, 2012 9:02 am

Okay basically an altercation took place in my private life. No laws were broken, it was a insult bashing thing.

Basically this guy who I don't really know that well insulted me and said I was slow in the head (I was in Special ED as a kid). I was pretty insulted so I insulted him back. He then took a transcript of what I said and emailed it to my boss. I did not make any threats or anything like that. I just insulted him...

I have since been fired because my company wont tolerate that kind of action. I'm wondering If I can sue the person who emailed my boss this info to get me fired.

He threatened to do this 2 days before he actually did it, so I know what his intents were... To get me fired. I found this online so I am curious if you guys think this qualifies?

The person damaged by the interference (the employee) will usually need to prove the following things in order to sue:
There was an existing employment relationship;
The person who caused the interference was a third party to the relationship (i.e. the relationship was not between the person damaged and the person who interfered);
The third party's conduct interfered with the relationship;
The third party intended to interfere; and
The third party's conduct caused the employee's termination.

Nope, you don't have grounds for a lawsuit. If he had lied, you would. But he didn't.

I wouldn't use legal match as a source for legal advice. You can try calling personal injury or employment law attorneys. But the cases you talk about a usually people who are harassing someone on a regular basis, trying to get them fired. This person just made your employer aware that you have a problem. You don't say what the insults were, but if they were racial, or against a certain group of people, then there was reason to be concerned.

You would have a tough time proving that the intent was to cause you to lose your job for NO justifiable reason. You don't have that proof.
