I'm not sure which aspect you're asking about. Is it "right and fair" to investigate when laws are suspected of being broken? I'd say it's more of an obligation than a right. Fairness is determined AFTER the investigation is complete, when charges/fines are assessed --- that is IF any fines or charges are imposed. And then there is always the appeal process, to ensure fairness. So, yes, based on what I assume you are asking, everything looks above board thus far.   @Goldie 9 months ago

You don't get to whine when your building gets red-tagged by the planning department for your failure to pull a permit, because "I planned to build it to code, anyway." It's the price of doing business, and the fine will probably be written off as part of the cost of doing business. then they will probably file the paperwork for the "take permit" because that sounds cheaper.   TheLightWorks 9 months ago

It's the "first utility-scale wind farm in Nevada and the first to be built on federal land anywhere in the United States" so it's open to additional scrutiny.Given that the facility was fast-tracked over the objections of environmentalists, I think everyone's bound to dot all the I's and cross all the T's. There hasn't been a fine levied, just an investigation. It's a pretty big over-site on the part of the developer not to have a federal ?take? permit that would allow the incidental death of a golden or bald eagle.You kill a protected species on federal land, you pay the piper.   ibstubro 9 months ago

I'm not certain that there is a cost for the permits. Let's wait and see if the farm is penalized or prosecuted for the death of the bird. The fish and wildlife service is required by law to investigate the death of the protected bird. The take permit was initiated in order to help encourage alternative energy development, by eliminating the red tape involved with inevitable hazards to wildlife. The permit is granted after the applicant shows reasonable plans to minimize the deaths of endangered animals. It's a sensible law, and it's puzzling that the farm failed to seek a permit.   stanleybmanly 9 months ago

I didn't see where it mentioned the cost of the permit.It was a multi-million dollar pilot program on federal land that was fast tracked against the objections of environmentalists. They shoulda bought the permit.   ibstubro 9 months ago
