Dual State Custody

Postby Ingall » Sun Jun 29, 2014 12:12 am

I live in Oregon, and have a shared parenting custody order with my son's father. I want to file for a change in custody and get physical custody of my son changed from his father to me. He and his father live in Ohio. How can I go about doing this from Oregon?

Dual State Custody

If the  current  order was entered in Oregon,  you could file your petition there. If the father objected, though, it would be sent to Ohio. If the order is in Ohio, you could not file in Oregon. All states have statutes and laws that require custody matters to be litigated where the child lives.
