If I File Chapter 7 Bankruptcy, Will My Wages Still Be Garnished?

No for the most part. Once you have retained an Attny. When creditors call, give them the name of your attny and the phone number and let them know you are filing bankruptcy. Yes even call the court house and let them know you?re plans, the cost varies because of how much you make, if you have credit card debt, the company can come to your bankruptcy hearing and  ask for the things  you purchased, you have that option  or you can return them yourself. But you need to contact an Attny. Now ! don?t wait, you will have to pay out anywhere from 1000 to 2500. but in the long run it will be worth it. Have you tried to go thru a consumer credit counseling? they will talk to all the people you owe and set up a payment plan you can live on and  still are not harassed by bill company. But you will have to make sure you pay the payment on time, they in turn will pay down your dept. Bankruptcy is the last thing to be done, in some states its on your credit report for up to 10 years. But going with a consumer credit counseling, you just have to pay the bills in full, and nothing as bad as bankruptcy on your credit reports. I suggest if you have someone that will do child care, id get a second job, and use that money to pay off your debts. When my son was little I worked full time, had a part time and went to college full time, this was to be able to support him and he was young enough, not to care he was a sitter?s home. I know it is?t easy, I too was a single parent, but with a college degree I made sure we would never live in poverty. There are many degrees that are 2 year, In the medical field when you finish school you will make excellent money,. Good luck to you and your child I hope everything works out.   you can run from the courts, contact the court house and set up a payment plan, this will show them that your are trying to at least pay as much as you can to fix the problem. tccat 64 months ago Please sign in to give a compliment. MightyCow_DontFollow said: 1 I would counsel you to think long and hard before jumping into bankruptcy. You're still responsible for some debts for one. You certainly won't be able to use it as a get out of jail free card for two. And it will mess up your credit for many years. It may be the right thing for you, but don't go into it thinking that it will solve all your problems. 64 months ago

Bankruptcy is pretty severe. It will affect your credit for at least 7 years, and any credit you apply for from now until them will have HIGH interest rates. Call DMV and see if it?s not too late to make payment arrangements.  They are going to tack on interest, penalties, fees...DMV is worse than the IRS. Also, if you get this resolved prior to the day that your wages are being garnished, make sure you call DMV to confirm that your wages will not be garnished. First of all, let's get this straight - you're not going to jail because you're poor, you'd be going to jail because you broke the law and then failed to pay the penalty.Filing a bankruptcy will not save you from the warrant or the fines, so that's not a good plan.If you're poor, you need to get with the local legal aid and see if they can help. You need to go to the court and plead your case - in most instances, the court will work a payment plan out with you. If not, take your kid to a family member or friend and go do your time until the fines are "paid" through the sentence.
