Email and internet slander or libel?

Postby caelin » Mon Oct 31, 2011 7:53 pm

a vindictive woman with whom I had a falling out is sending emails saying my charity is a scam AND is posting derogatory notes about it on Facebook. What area of the law would cover this?

Email and internet slander or libel?

It's libel and defamation IF it's not true. IF it's true, then you could sue, but you have to prove your charity is legit and that you have been damaged. Hard to prove.

If she is just expressing an opinion and not stating it as a fact, then there is nothing you can do.

If she is making specific PUBLIC claims which are false, AND you suffered damages, you may be able to sue for libel. If she can prove that her claims are true, you will lose, of course.

As for 'derogatory notes', again, if they are statements of fact and are untrue, the same situation applies. Opinion, however, is not libellous.

"Bob is a thief" is libelous if Bob is not a thief. "Bob is a jerk" is NOT, it is merely an opinion.
