Exhumation For Cremation

thirteen years ago we buried my brother. Since then we have changed our mind and wish to have him exhumed and cremated. What are the legal ramifications behind this process. Our family is in agreement and he had a common law wife whom we have not asked. Can you give me an idea of the cost of this process. Thank you.

My first question would be, is a common law spouse considered the legal next of kin in the state where your Brother died ?  2nd  Are there any children from this union ?  My best advise would be to check with the state agency that regulates funeral homes/directors and/or cemeteries in the state where he died. They could probably give you the exact answer.
