Fighting a public urination ticket?

Postby tim » Mon Jul 30, 2012 4:17 am

Hi, YA.... I was driving through downtown Denver with a friend of mine, I picked him from the eastern side of Denver and drove through downtown which is filled with bars and restaurants. It was about midnight and after many stop lights and traffic we made it through to the other side. I stopped at a gas station which was closed b/c I needed to use the restroom. They were closed so I rolled to the other side of the campus where there was an open gas station. I went into the gas station to buy gas (paying customer) and the male's bathroom was blocked off with wet mop tape and unusable. I really had to pee after about an hour of driving and drinking lots of iced tea. Since they didn't have an available restroom I decided I was about to piss myself. I walked out back about 20 yards into the seclusion of darkness and went pee. When I was done I was met with an extremely aggressive cop with a flashlight. He told me to produce my ID and "get the **** over to his car" After aggressively grilling and berating me he asked me why I was peeing in a public area. I told him I really, really had to go. His acquaintance seemed unconcerned and asked me why I peed in "public." I told him there was no restroom and I had to go, he said "oh it's one of those things" the other officer got much more aggressive and said he was going to make me a sex offender. I was cited for public urination, he wrote female on my ticket and was verbally abusive. It's a misdeamnor in Colorado, but it's also considered an infraction depending on circumstance. I wasn't intoxicated and was helpful. He also wrote female on my ticket. Can I fight the charges based on this? Also how should I plead in front of the judge? I have court on monday. Thanks for your help.

Why fight it? You did exactly what the infraction says you did. You peed in public, and got caught. Accept the consequences.

Don't outsource blame that belongs in your own backyard.

Maybe you shouldn't have drank so much iced tea, or maybe you could have drove a little further to find a place that was open. I don't know, I wasn't there. But the law is the law regardless of circumstance.
