Filing small claim court for insurance deductible in NY?

Postby adalwine » Wed Aug 01, 2012 7:31 pm

I've got into a car accident where it was 100% not my fault, the other driver ran the red light on the intersection and there was a crossing guard lady standing there and she stated on the police report that the other driver ran the red light. So i got my car fixed through Gieco, but i had to pay a 500$ deductible, Gieco told me they will contact State Farm( the other drivers insurance company) to get back my deductible.Been like a month already i called them, they told me they never sent them the police report, so i was wondering if Geico wont do anything for my 500$ deductible which i desperately need, can i either contact the other insurance company on my own or file a small claim? If i file a claim in court, what kind of paper work, documentation proof will i need to make sure i win my money back, never filed any sort of a claim before, thanks.

Why didn't his insurer take care of the repairs to begin with there would have been no deductible? Anyway you can file a small claims case if nothing else is working. It will cost a small amount to file and all your repair receipts and pay outs will be needed.
