FL EVICTION "CURE" QUESTION?

Postby jen » Thu Jul 26, 2012 4:49 pm

My landlord isn't affording me the time to pay rent. I am a student and get my aid on certain dates, I explained this to my landlord, but they are filing for eviction anymore. I INTEND ON PAYING RENT ASAP. WITHIN THE NEXT TWO WEEKS

MY QUESTION IS: Can I pay rent (full rent) at any time during the eviction process, or is there a certain point where it is too late? Obviously, I know if the sheriff officially evicts me, it is too late, but I am talking about is there any time BEFORE I get officially removed by the sheriff where it is too late to pay rent, or any time during the proceedings where the landlord can refuse my rent and evict me anyway despite me trying to pay?

FL EVICTION "CURE" QUESTION?

Postby orson19 » Thu Jul 26, 2012 4:57 pm

It is really hard to get a person evicted from there home. there is legal process that the landlord has to abide to. this usually takes a bit of time. so say if the landlord goes to court to file for eviction. first he has to wait for the court date. then you will be served an eviction notice of 2 weeks. that will give you ample time to come up with the money.

If you got served already, that means that ur landlord is no longer willing to take anymore payments from you he wants you out. so this means you have to go to housing court. DO NOT ANY ANY POINT GIVE THE LANDLORD ANY MONEY!!! if you do this, and you have the eviction notice he still wants you out and now he has ur money.

when you get to court he might at this point be willing to sit in mediation. this is when the two of you sit down with a court mediator and come up with a solution. it will be extremely helpful for you to have all the rent up front ready to pay off he lets you stay. and you need to reset a better time to pay rent.

He could want you out still but hopefully the judge will help you out. it will look good for you if you are no more then 5 days late. so say if you agreed to pay on the first of the month but you pay on the 5th the judge will laugh in this landlords face. If you are a good tenants not causing any ruckous or damage to the property etc... its good.

but really its in the judges hand at this point. he could say you must leave.

EDIT: if the landlord goes in with a lawyer. that lawyer will try to scare you into signing an agreement before seeing the judge, if you give in out of fear you are screwed. so if you can't come to an agreement SEE THE JUDGE FIRST. do not sign anything that the landlord or his lawyer tries to make you sign. you have the option of letting the judge decided for you.

also before you go i would take picture of ur apartment. take pictures of everything single wall, all the carpets, or floors, under sinks everything! so if the landlord tries to say she has destroyed the property etc... u have proof its all lies. then he will be held in contempt.
