A few years ago a group BBQ at work resulted in me getting food poisoning. I got really sick from it because I have a digestive disease. No body else got sick, but I heard that someone intentionally contaminated my food with raw chicken as a 'joke'. I didn't report it as an injury or anything because I was unsure if it was true and didn't want to make false accusations and cause problems. I returned to work after a few weeks for two more days to collect my things because there was an an expected layoff as this was a temporary position. I remained unable to work for several months and even when I returned to other employment I was only able to work for two months before I had to stop working. That was three years ago and haven't been able to work since. With the combination of the food poisoning and the digestive disorder, I ended up in the hospital and my health was very bad for two more years. I'm only now starting to get better with expensive medication. I've gone through my entire life savings, my medical expense coverage is maxed out and I'm still not well enough to work.
Am I able to make a WSIB (Ontario) claim on this incident? If this is an acceptable claim is it to late? What would I need and have to do to prove the case? I did go to the hospital, the Doctor said it could be the food and could be the digestive condition but didn't make any statement to my work place. If I initiate a claim, how long would it be before anything was payed to me? What can I do?
