Garnishment / Collateral In Marital Property

Postby denzell » Mon Jun 23, 2014 3:42 am

Im dealing with a breakup at this time and my soon-to be-ex believes there's a lot of collateral in the home. To maintain the home I'd to market the home to my mom, I didnt create her spend the final price, I settled these, and so I just obtained a look for approximately 00 which taken care of even more final cost and that I needed to obtain a new-car, I'm providing my ex the car that will be worth approximately 00. my soon-to be-ex wishes 1/2 of the collateral. He explained easily didnt spend then my earnings could be garnished, is that this accurate?

Garnishment / Equity In Marital Home

Postby Adelbert » Tue Jul 01, 2014 3:45 am

The bigger issue is whether your mom settled fair-market price for that home. Should you offered her the home at below-market value, and also the judge analyzes a greater market value, he might be eligible for equity-based upon the estimated value of the house in the place of the purchase price.<br />
It's fairly uncommon for earnings to become garnished towards the end of the divorce process, however, if the regulation enables it, it's not away from world of possibility.
