Has anyone contacted the Attorney General for wrongful termination?

Postby westbroc90 » Sat Feb 25, 2012 8:27 pm

I 've send a letter via mail Friday to the NY Attorney General for being laid off the day I told them I had jury duty service. Here's the law in NY from their website

B. Can I be fired for serving Jury Duty?
No. An employer notified in advance of a jury duty summons may not fire an employee because of that absence. Workers who are fired because they missed work to fulfill a jury duty obligation should contact the Attorney General, Labor Bureau at (212) 416-8700 or complete the attached complaint form. The problem is proving that's why you were terminated. If they were going to do the lay off anyway, then it wasn't because you were going for jury duty. Odds are, this was already in the works before you said something about jury duty. So it's just coincidental. Especially if others were laid off at the same time.

I doubt the AG will do much with it unless you have it in writing that they laid you off because of jury duty. They will probably have documentation that the layoff was already in the works.

Why did you do a letter rather than call the phone number of completing the form?

You have to prove that was the reason why you were laid off. Right to work also means right to fire.

You will probably lose your claim but go ahead and try.
