Hidden Canyon HOA is selling my home due to nonpayment of dues. Would filing bankruptcy stop this? What can I do to stop this? Who is in charge of this HOA, who do they answer to? Thank u!

Unfortunately this is a legal question that I am not allowed to answer as per our MLS, but I CAN direct you to a local attorney's firm that could certainly answer it for you and give you all your alternatives. Dearest Tonnesens: I just had to write you! It is due to you and your encouragement, letting me know I was not alone, that I actually pulled myself up by the bootstraps and started fighting back!!! Yes. First, the most excellent news! The sale of my home was postponed til January!! I have a final appt with BofA to modify my loan on Thursday. I have an appointment tomorrow w Haines & Krieger, thanks for the tip. Also on Friday I'm meeting with James Adams Law Firm who is filing a class action suit on behalf of RE investors who feel they are being gouged by HOAs, Collection Agencies and Attorneys. I could put all eggs in one basket, so I wrote letters to HOA and Alessi & Koenig(collection agency) requesting an explaination of sale and breakdown of costs. you wouldnt believe it, $295 to send me a letter?! I dont want to bore you with details, but suffice to say that when a professional, you, pretty much validates that I had every right to be pissed off! I felt empowered. Perhaps the class action suit is doing some good, cause Hidden Canyon says that they now bill from within, no longer use a collection agency and are trying to be a more homeowner friendly entity. Good and bad, cause i'm still w Alessi & Koenig. I wonder if ther is any way of disassociating my home from their bill?? Whereas they have to send me a bill and wait on it and not be able to touch my home. What do you think? Shelley, that is truly excellent and most AWESOME! I have seen way too many people losing their homes these past two years, and I just want to cry every time. I definitely do think the class action suits that are coming up against the HOAs are going to do a lot of good - we need to bring the property management companies back in line and stop the bleeding!!! You really did this all yourself -  we just confirmed your suspicions that you were in the right.(On the other hand, where can I get a job writing those form letters at $295 a clip??? I can whip at least 20 of those out an hour!)

Another thought - when you talk with Haines and Krieger, let them know about the loan mod. You may want them to review the paperwork, because we are finding that a lot of the loan servicers(like B of A!) have extra fees tucked into the new principal balance that should NOT be there. And feel free to "friend" me on Facebook.(You can then see my 11 photo albums I just posted from our last vacation. LOL) I can't friend you, because I don't know your last name and there are a number of Shelleys from Vegas on there. Unless you are listed as Shelley the comic? Where do you perform? Maybe I can come see you! And I don't think I've ever had a fan club before. :) But just look for my name, Diann Tonnesen, and send me a friend request. I would love it!
