How come I only get a ten minute break?

Postby stein74 » Sat May 05, 2012 6:49 am

When I work a 4 hour shift, I don't get a break at all. When I work a six hour shift, I only get a ten minute break. I thought the law requires a thirty minute break for a six hour shift. By the way, the job is in the fast food industry and is located in California. Also, the place is a local franchise rather than a corporate franchise.

I work 12 hour shifts and sometimes I don't even have time to have any break. I work on a drilling rig and it's an old-school one with tongs and spinning chain, pretty hard work. I don't complain!

Read the posted work rules at your workplace.
You only get 10 minutes if you work less than eight hours.
Thirty minutes if you work six to eight.
It is posted by your time clock.

Every employer is different. Ask them what their policy is. If you don't like it, look for other employment.

The fast food industry is rough - they don't like to give breaks.

You get a 10 minute break for each work period of 4 hours, or a substantial portion of that. A "substantial portion" is OVER 2 hours, so one 10 minute break is right for a 6-hour shift. However, you should also be getting a 30 minute meal period since you are working more than 5 hours (which you and your employer can waive since you are not working more than 6 hours).

If you are unlawfully being denied a meal break, you can make a wage claim.
