How do I go about filing medical malpractice?

Postby spengler » Mon Oct 31, 2011 2:28 pm

My husband had surgery in sept. 2010. He has a 25 year old malunion of the elbow. This Orthopedic surgeon supposedly fixed it in (ohio). We went to all the after surgery appointments and physical therapy. This dr released him to work and all. We moved to Michigan and he was already having issues with it. At his last appointment in (ohio) the dr there said he seen that a screw was broken and it should be ok. So here in Michigan I took him to the hospital, they said he has bone fragments from a fracture and his hardware is shot. How would I go about a malpractice lawsuit? In ohio or michigan? I need help fast because they laws state I have to file within a year or the procedure. PLEASE HELP!? Its hard for him to work and support us as a family and be in pain. They just keep putting him on pain meds that eventually are going to cause other harm too. Thanks and bless all! If I didn't give enough info, please inform me so I can add detail and what detail you need.

I don't know that I necessarily see any malpractice here...

Look up "malpractice attorney" in the phone book or online. Those guys advertise like crazy and you will not have a problem finding one in your area. They'll take it from there.

I am not seeing malpractice from your description but since that wasn't your question......

you need an attorney. You cannot win a malpractice case without one. try www.martindale.com and find one in your area
