How do you determine the value of a personal injury claim for a serious car accident?

Obviously Curious doesn't work for an Insurance Company or know how to evaluate claims. There are many factors considered when evaluating a serious injury claim. They look at the type and seriousness of the injury, the recovery factor(any permanent disabilities), how the injury has affected your life, wage loss, related medical bills(past,current and future), and pain and suffering. They also take into consideration your age, marital status, dependents and type of work you used to do and what you can currently do or do in the future. Then they tailor the settlement to fit your circumstance. Hopefully there is adequate coverage to meet your requirements. If you hired an attorney to handle the claim for you, he/she will take 1/3rd of your settlement as their fee. Good Luck

Usually it's based on 3x medical costs...
Unfortunately, you won't get anywhere near that. You will get what the other driver is insured for. The insurance company does not need to pay more than that.

You can then sue the individual personally and you would get the judgement. However, it's doubtful you will get the money. If the accident is with "regular guy joe", he doesn't have the money to pay you and you can get make money appear that doesn't exist.

I know you don't want to hear this... sorry!
