How do you get a refund for taxes taken out of your workers compensation?

My husbands job pays him full pay as part of his contract (he works for NYS) while he was off on workers compensation from Aug-Dec. So the workes compensation checks went directly to the state. The thing is they took taxes out of him just like he was still working. I'm pretty sure we are entitled to get all the taxes back that they took out, but I have no idea which taxes or how to figure it out. Any help and/or links would be greatly appreciated.

Nope That case was tried in 1980. You receive your regular paycheck and taxes are withheld.
A Workman's' comp check is usually only 50% of your salary. You decide would you rather have full pay or 50%
