How hard is it to take a NY state County to court for legal malpractice on part of the Public Defender's Ofic?

I was found guilty of Rape in the 3rd for having sex w/ a 16 year old while I was 21 years old about 7 years ago. I was unfairly treated with the matter because the girl's mother had too much influence in Allegany County NY. I had a plea deal worked out that would prevent me from registering on the NYS Sex Offender Registry and the Public Defender handling my case, (Patricia Fogarty) didn't make it to court on the deadline for the deal. This action caused my case to be forwarded to the Grand Jury for felony charges. My deal was for a non felony offense, no registration, and 45 days in Jail. Instead of this, I spent 225 days in jail and was forced to register as a sex offender. Do I have a chance to take them to court for legal malpractice. I urge anyone who has any input on this matter to come forth so that I can get a better understanding of my chances in this matter. Thank you for hearing my question...

You cannot sue a public defender and the only thing you could do would be to file a complaint with the attorney disciplinary commission and file a petition with the court to have your case reviewed.{}
