How long does a personal injury claim take?

Hi i put in a claim against my previous employer for a injury i suffered to my leg, this was bk im May last year, i was told by my solicitor that once the claim was made to my previous employer they have approximately 12 weeks to deny or except liability, well They did respond but they did not deny liability nor except it either they just gave a load of rubbish my solicitor said its common to allow more time for an answer but this was started May last year is my solicitor being lazy or is this just the norm any information on the process of these cases and whats to happen next would be great

Contact ACAS, the employment law experts, for anything to do with employment queries and problems. They will give you free, impartial and confidential advice. Masses of useful info, plus contact details, on their website: www.acas.org.uk

The timeline is different for each case because of the varied nature of the injuries and case facts. In general claims involving straightforward injuries such as simple fractures - soft tissue injury - whiplash etc with no issue on liability can be settled within 6-8 months. The delay may be due to your solicitor not putting your case as a top priority. You need to follow up with him.

Forget ACAS they do not deal with personal injury. You need to shake up your Solicitor. Make an appointment and ask what is the delay and how is he handling it. There are legal guidelines as to how long it should take in these cases, Insurers drag their feet hoping you will go away.
My injury claim took 3 years as I had to have an op then medical reports.
get on to your Solicitor straight away and ask for an explanation. They were not quoting rubbish, you just did not understand the legal complexities.

Much depends on the actual circumstances of the case. Many cases take years to be concluded.

But keep on to your solicitor to make sure that all delays are on the other side.
