How long notice does landlord have to give (3)?

Postby madison86 » Mon Dec 19, 2011 5:20 am

looking for specifics

I'm re-posting my question with more details.. so copy and pasted

How long of a notice does the land lord have to give before evicting you? The landlord is giving us less than 3 weeks to be completely moved out. I'm pretty sure the landlord has done things not allowed by law. For example coming into the house at all hours of the day, even at night time. They also bring their family and just go off and come sit in our living room and watch movies?? Once there was also a time they brought their daughter in and had he start playing violin? what the heck? My mother and I have ear problems, not to mention we were sick at the time this happened. Is there anything I can do about this? Also we are in the state of Virginia. Any links would be helpful, or anyone who has had experience would help. Anything that you want to stay would help a lot too, for example anything that you have gone though. Thanks!

Additional Details
more details: we had a 6 month lease that ends on June 1st. he has having us move out may 31st as well. also we did not allow it, we told them that we didn't like that they were coming without notice constantly which is another question i forgot to ask. do they have to give notice prior to coming to the premises?

Additional Details
more to add for "the kid's" question.

the lease states that it is the tenant will pay annually 12,000, (1000 a month). but the lease is 6 months. It was supposed to be month to month payments after the 6 months, until the 12 months, in which case another agreement would be made (i think?). We were late on rent once, but paid it only a couple days after it was due (the lease also says that it must be paid before the 3rd, rent is due on the 1st, or there will be a late fee) some family members had to go to the hospital so that is the reason we were late, but i think it is an eviction because of the fact that it was supposed to be 12 months, but month to month after the 6th? I'm not sure I'm not the one paying the bills. I'm only 16 trying to get answers.. thanks

Since you are on a month to month agreement, the landlord only has to give you 30 Days notice to vacate.

when the LL visits, it is 100% fine to ask "what maintenance are you providing today?"
if he says, NONE or I am not sure.......say "have a good day and I am busy and close the
door. IF he uses his key to unlock the door.........igore it and call a locksmith.
have the locks changed. YOURS is the 2nd query like this today; i have never ever known
a LL to just visit.......he is too busy.

Again, you NEED to understand that any previous 'landlord violations' have NO bearing on your lease agreement. If there WERE violations, such needed to be handled separately. You NEED to refer to your lease contract, as well as to your state's statutes regarding your tenancy.
