I-130 In F2a, F2b Category

Postby Diggory » Fri Feb 07, 2014 1:41 pm

hello,

i am in an f2 petition, from what i understand, f2 is an UMARRIED child 21 of a permanent resident. now i am married, if my petition would push through, will i be able to bring my wife and kids with me? should i notify the national visa center of my current status? how would it affect my petition?

thanks

theo

ANSWER: Hi,

You and your family will not be able to immigrate based on F2 category, as you are now married.

I recommend that the petitioner(your parent) become a U.S. citizen, and then a new I-130 petition should be filed. This will be in the 3rd family preference category, as married child of U.S. citizen. Additional information about the family sponsorship categories is here: www.h1b1.com/sponsor.htm
