(c) Evaluate using relevant case law whether Fatima will be held liable for the actions of Gemma in the following scenario.
Fatima is the owner of a small advertising company. She employs two members of staff, Gemma (a personal assistant) and Harry (an artist). On 14th December, Fatima asked Gemma to take an urgent package to a client. Fatima owned a sports car which she told Gemma to use to deliver the package. Gemma delivered the package. She enjoyed driving the sports car fast and decided to use a longer route back to the agency so that she could enjoy driving the car for a longer time.
As Gemma approached a pedestrian crossing, Indy stepped on to the crossing in front of the car. Gemma was unable to avoid Indy and the car struck Indy breaking her leg.
Indy is now suing Fatima for compensation in respect of her personal injuries.
