I got a speeding ticket and decided to go to court to fight it?

Postby therron57 » Sat Apr 02, 2011 1:45 am

Few months back I got a speeding ticket on the freeway , it was late at night and the freeway was literally empty and i had the music on and i got carried away. The police stopped me, I am wondering do they use radar gun to find out my speed? The other thing, I want to go to court to fight it, or at least lower the cost and try to avoid my insurance from rising.
How do I approach the judge? What do I say?

Go to the judge and tell them exactly what you said here. It was late, you were listening to loud music and got carried away. I'm sure that will go over very well.

Your parents should be shot for raising you so poorly.

You should always fight a ticket if possible.

You have two options when you get there. First, you can talk to the prosecutor / cop and work out a deal for a lower fine in exchange for a guilty plea.

Second, you can use legal strategy to beat the ticket. If the officer who gave you the ticket isn't at your trial, they have no witness and you can point that out and win. If he is there, you can question his reports regarding your speed and how he calculated it. Trip him up on any question and you can claim that his testimony is unreliable. Read your state's traffic laws: you may find that the speed limit signs are incorrectly placed, making tickets unenforceable.

Be warned though, the police have been in many more courtrooms than you and they know the ins and outs. If you try legal strategy, expect to lose. But the worst that happens is that you have to pay the fine. Better to try to beat it than putting your tail between your legs and sulking away without a fight.

admit guilt, ask for leniency. Explain your insurance issue, and if you don't have alot on your driving record. The judge will be lenient.

I wouldn't go to court if I were you. that puts you more at risk then you already are. A law is a law. if you break it, you have to do what is expected from you. not go against it.

They could have used radar, laser, pacing or aircraft.

The fact that the road was empty isn't a defense. Obviously there was at least more car there than you thought and that was the cop that got you.

I think you are wasting yours and the court's time, but I wish you luck.

How bout you just accept the fact that you broke the law and take the punishment given to you.

3 months is probably to long to challenge a ticket. It probably says on the ticket how to challenge it. The places were I have lived expect you to notify the courts within 30 days if you plan to fight the ticket. Always challenge all your tickets, often the cops are to busy to even show up to defend the ticket, or the crown will offer a lesser penalty.

it is obvious you are guilty, you said so yourself that you got carried away. it doesnt matter if there were no cars on the freeway, law is law, and you broke it there is absolutely no chance of you getting this off your record. because yes, police men do use radar.... and if and when he uses it against you then your defense goes out the window.
