a former employer. How do I request information from him (employment records) for me to use in court?

Don't know that you legally can request records. Your small claims application has your complaint and it is up to the defendant whether or not to show the employment records. Only the court can request info from him and that will be unlikely. Don't worry, if he elects to go to small claims court instead of settling he will have all the records he needs to present to the court. It is up to you to prove them false or to convince the commissioner(not a judge in small claims court) that you suffered financial burden or loss because of his actions. Small Claims court is not as easy to get a judgment in your favor as many people think it is. And if you fail to convince the commissioner that you should be awarded a judgment you will be responsible for the court costs.

The commissioner will try to meet with both parties in an effort to settle your dispute out of court.
