I'm soo confused about this K3 visa.plz help!!!?

Postby jolie95 » Wed Apr 13, 2011 2:52 pm

I read in uscis site that;"Immigration law allows the alien spouse of a U.S. citizen and his or her minor children to be admitted to the United States as nonimmigrants while they are awaiting the adjudication of a Form I-130 Petition for Alien Relative. It also allows them to obtain employment authorization while they are waiting."
I filed both I130 and I129F,which is also K3,So that means my wife will be able to come to the states before I130 is completely processed?plz provide me with guidances here.i'm really lost.it's too hard to understand immigration for me.Thank you in advance.

Bringing your wife here can be a complicated process if not dealt with correctly. I suggest you hire an immigration lawyer. They will take you step by step as to what forms need to be completed and they will complete those forms with you.. if i were you, id sit with the lawyer and watch him complete the forms and make sure that each question is answered CORRECTLY and HONESTLY. EVen immigration lawyers make mistakes so you need to make sure you look at the forms before submitting them.. this process can take a minimum of one year... meaning you have to wait a whole year before your wife can be approved for a visa to the USA. Make sure you guys take lots of pictures together because you will need to send photos of you guys together (I'd say about 30 photos) as proof that u have a legit relationship with her. After completing all the forms, (which your lawyer will explain further to you about the individual forms), your wife will be called to set up an interview with the US embassy in her native country that she resides in. She must answer all the questions they ask her truthfully. At the interview they will either acccept or deny her visa. As for her children, if they are not your children, then I am not quite sure how that works.. your lawyer will explain that for you.. its important to know that if you make ONE little tiny mistake on a question in one of the forms, it could potentially make the wait months longer.. ONE year is the minimum wait IF and ONLY IF all the forms are completely correctly. Its actually quite easyyy to make mistakes! If you have any question, feel free to email me. I am actually very well aware of immigration laws since my brother just brought his wife from Europe! Their process took a lil over a year because they missed a question and forgot to fill it out on one of the forms. but i would DEFINETELY hire an immigration lawyer! Good Luck!

The intent of the K-3 is to allow foreign spouses of Americans to come quickly in nonimmigrant status while waiting for their immigrant petitions to be processed. but lately, the I-130 is being processed in about the same amount of time, so there's little real time being saved. so, if you've filed both, she'll stil probably come in on the CR-1, and you're both better of if she does. If she comes in on the immigrant visa, she'll be processed for the green card right away and probably get it within a month or two. If she comes in on the K-3., you'll need to file an I-485 adjustment of status form for her so she can get her green card, it will take a lot longer to actually get it, and it costs over $1,000 to file the I-485.
