I need some legal information on common law marriage type situation. ?

Postby sylvester37 » Sat May 12, 2012 2:20 pm

My grandfather and his girlfriend of 23 years broke up. It was her choice because she feels he is cramping her style as still wants to go out every night like a twenty year old as well as dress like one; as my grandfather is rather old and shows it after many years of hard work he would rather sit at home and relax. No that they are split his now ex is picking what he can have from the house they had together. She is not wen allowing him to have all of his thing and is selling things right in front of him and telling him he can't do anything about it. Is there anything my family and I can do to help him get his things and his portion of the things out of the house in a legal way that she can't stop?

It's going to depend on whether he owned those things before they moved in together.

The thing is, in a marriage or even in just in cohabitation, if both parties were contributing to the relationship, then BOTH parties have ownership of the goods that were purchased during that time.

Your family can only do something about it if your grandfather is mentally incompetent. Otherwise, he needs to get a lawyer and look after his own interests, like any other adult.
