I put in my 2 weeks notice with my employer. They turned around and fired me.?

Postby bellden » Mon Apr 11, 2011 9:41 am

I was told that while they have the right to do so, that they had to compensate me for the money I would have made in those two weeks. Does anybody know anything about Missouri labor laws? Also, can I file for unemployment for being fired like this?

Legally, I believe you may be entitled to unemployment insurance for the two weeks, but it may be hard to get it. Did you give notice because you were starting another job? Hopefully you have something else to go to soon. And they *did* fire you - you didn't want to leave for another two weeks. Either way, the company's move was low-class.

Personally, I would send an email to all my friends at the company letting them know that the company fired you immediately upon 2 weeks notice, and recommending that they not give any notice if they plan to change jobs.

Sorry for the life lesson - good luck!

No there is nothing you can receive. Missouri like all of the other states except Montana is an "employment at will" state. This means you can quit when ever you want to and they can fire you when ever they want to. It is not even unusual for a employer to do that.

And no you can't get UI, you quit. And even if you could you would only get at most a week because of the waiting period.

They fired you, most likely so they would not have to pay their percentage of unempolyment. You can still apply for unempolyment it will be more diffucult to get however, it's still possible to collect.
Google unempolyment for your state. You'll fine alot of your questions answered there,

Most states are titled as 'at-will'....this means they can get rid of you and NOT have to tell you why and YOU can leave without telling them why..... Therefore, YES they can fire you.
Why are you going to file for unemployment if you gave a 2-weeks notice......a person only gives a 2-weeks notice when they have another job to go to or are moving out of the area.............

2 week notice is a courtesy to an employer. There is NOTHING that says they have to accept it. And, no. You can't get unemployment because they didn't fire you. You QUIT. They just didn't want your notice, and let you leave immediately.

The person who told you that is an idiot.

No employer wants someone around who is no longer "on the team." And you do not qualify for unemployment. You quit, remember? All your employer do is make it immediate.

No, even if you give two weeks you can still be terminated. It happens all the time. Otherwise people would give notice and then cut up for 2 weeks without fear of termination and we'd have chaos.

They don't have to compensate you. You weren't fired, by the way, you quit. Either way, you can't get unemployment.

Employment in MO is at will, and they could have fired you on the spot even if you hadn't given notice without paying you at all.
