3 months ago my neighbors car blew up. He was out of work and she was working at a sandwich shop supporting the family. They had no money. I told them they could drive my truck. A week later he came to me and asked if they could buy it on payments and that he had gotten a job on the pipeline up north. He could not promise any specific amount but said that payments would be made every two weeks. They have paid 130.00 in three months and today I sent a notarized letter stating I wanted my key back and they could park the truck in my parking lot. She showed up with a 300.00 payment but I refused saying I did not want to deal with them anymore. She said she was not going to give back the truck and would hide it. I explained the law. There is no contract at all but in my letter I did acknowledge the 130.00 payment. The truck title is in my name and it is registered in my name and they have been carrying insurance.
We live in an apartment building. They are my neighbors...our apartments share a wall. They have not spoken to me in 6 weeks and when I knocked on the door they ignored me. She would not have showed up with a payment if I had not written the note asking for my key and truck back.
Am I in the wrong? I do not feel that I am. She actually asked me for the 130.00 back that they had paid.
I did seek legal counsel, so that is why I sent the letter and gave 24 hours for compliance. I am a single mother of 4 and no one pays my bills...I cannot afford to let them drive my vehicle. There is already damage to it and I do not want it damaged further. To clarify the payments.....50 was paid the first week and 80 was paid two weeks later. Since then, nothing and no communication even when he was home on vacation for the holidays at Thanksgiving.
