Since you were fired, you don't have to file a complaint with Personnel or Human Resources. Call the EEOC or your state's Human Rights Division and file a claim for unlawful discharge. File for unemployment with your state's department of labor. If you're doing drugs, quit it and get a clean test. I'm an attorney for a local government and I know our state lab makes mistakes. Also, consult a labor law atty. You may not need an atty, but you need advice on how to proceed in your state. There are some tight time deadlines in my state. Call your state bar office and see if they have a lawyer referral system for attorneys who will give free advice. If not, cough up a $150-$200 for a consultation. The EEOC and Human Rights process is free and they supply an atty for you. In my state, it's helpful--though not required--to have a lawyer for the labor process to get unemployment. The law is in your favor. Companies are held to strict compliance with any state statute governing workers' rights.
