I was fired for a supposed positive drug screen i need advice?

they told me that my drug screen was positive, but i never saw any paperwork on it. in iowa there is a state law that says they must send a certified letter stating results and how to protest the results. i never recieved any such letter(iowa code 730.5(7)i(1)&(2) what can i do legally?

Since you were fired, you don't have to file a complaint with Personnel or Human Resources. Call the EEOC or your state's Human Rights Division and file a claim for unlawful discharge. File for unemployment with your state's department of labor. If you're doing drugs, quit it and get a clean test. I'm an attorney for a local government and I know our state lab makes mistakes. Also, consult a labor law atty. You may not need an atty, but you need advice on how to proceed in your state. There are some tight time deadlines in my state. Call your state bar office and see if they have a lawyer referral system for attorneys who will give free advice. If not, cough up a $150-$200 for a consultation. The EEOC and Human Rights process is free and they supply an atty for you. In my state, it's helpful--though not required--to have a lawyer for the labor process to get unemployment. The law is in your favor. Companies are held to strict compliance with any state statute governing workers' rights.

I would start by getting a hold of the HR department and let them know that by law you are entilted to see that paperwork and if they have a problem with that you will be seeking legal adivce on the matter. Companies hate lawyers, most likely they will be happy to provide you with the information. If not, find one of those tv lawyers (seriously not joking) call them for a free consultation and find out what course of action they may be able to help you with. I guess it depends on how good the job was as to how far you want to take the case.

No way would I take that lying down as they say . Makes no difference if it's deserved or not . Be assertive and defend yourself . Makes no difference also if the job in itself was worth it or not . Get that off your record at all cost. Prescription drugs can be a cause also .
