I lived in washington all my life but moved to texas and got married. we separated and i moved back to Wa. What law applies in the divorce? washington or texas? because texas is a community property state he said his atty said that when i left what i took is all i can get and that i can't get nothing from him.

Either he is lying or his lawyer is lying because, yes, Texas is a community property state so, since the marriage was in Texas, community property laws apply. That means the two (2) of you split the property and debts 50-50 not that you just get what you took.

Talk to a lawyer but, generally, the law of the state where the property was acquired (and you were living at the time of the marriage) controls even if you file in another state.

The state you file in. Generally that's the state where you live at the time.

You can file in either state - but Washington is your state of residency, so it's easiest to file there.

How about you hire your own attorney and see what SHE says?

You file in the state that you reside in. Most states you have to live there for 6 months to be a resident. You need to find an attorney and start asking questions.

Find and ask an attorney. It will probably boil down to which of you files, whomever files first will probably determine the state that governs. That was kind of silly to take off like that without understanding the potential ramifications.
