each month i am late with my rent but it gets paid even before my landlord goes to the bank but sometimes not.. if i say that it will be paid.. and every time it is. is that subject for terms of eviction.. as i let them know wednesday i will have the rest of the balance of the rent. its now saturday. and i get a letter that states that the eviction process will be started if i do not contact them within 24 hours.. somehow i feel like they single me out cause this eviction word is always the case with these people.. i want to move but foward not backwards or with a job and into something better not homeless selling everything i own for the guy..

Yes it is. Your lease gives the specific date rent is due. You are constantly late and the landlord is fed up with your inability to abide by the lease.

No landlord ever has to play lets make a deal with you and accept what ever you give them when ever you feel like giving it. If you are currently short then they have every right to evict you. A landlord can evict anytime the rent is not paid in full. A partial payment will not stop you from getting evicted.

Tenants think it is OK to pay late all the time if they pay the late fee but that is NOT correct. Even if you are current on the rent, it is legal in some states to evict a tenant for being constantly late.

Either way it sounds like they are sick of your constant late payments & are not going to put up with it anymore.

Yes. Rent being ONE day late is grounds for eviction.

Yes, chronically tardy rent is an evicatble offense. It doesn't even need to be chronic. If you aren't going to abide by the terms of the lease the landlord has every right to evict you.

You can be evicted for being one second late the first time. Wouldn't you be pissed if your employer said, "Well, I don't have the money to pay you today, how does next week sound?" Especially if he did it every single paycheck?

Sorry, but you are effectively violating your lease by stealing your landlord's income every month. He doesn't have to put up with it, and it sounds like he is done. With an eviction on your record, you are going to find it very difficult finding a decent place to rent for the next 10-20 years. You will also have a huge ding on your credit for the next 7-10 years for the lawsuit coming your way. Your wages will probably be garnished, as well, which is grounds for termination in some states.

Legally...the landlord can begin the eviction process after rent is only 1 day late. Sounds like your landlord is tired of you paying late and has taken steps to put an end to it.
