If I sold my rental unit to a family member to live in could they kick out the unruly renters?

Postby jarel » Tue Jul 03, 2012 11:53 am

I have very bad renters that have had the police called on them multiple times for domestic issues and noise complaints from fighting. They have been threatening me telling me that they will stall my eviction of them and how they are very familiar with the process. I really want them out quickly but I know how much the law favors renters instead of the home owner. So please are there any ideas on how to quickly kick them out? And will my idea work?

You should have checked their references. Start by sending an eviction notice and talk to the police about it.

Selling the property just transfers the lease to the new owner. It doesn't allow the owner before or after an out for evicting.

Renters can not stall an eviction process. Just make sure you evict them for being a nuisance. There is not pose-able argument to being a nuisance. Selling the property to a family member is not necessary to evict. If you can't make it to the court house to file the eviction and show up for the court date, hire a lawyer. The owner, whether it be you or a family member can not legally physically remove a tenant from a property. Part of the eviction process includes something called a lawful detainer which is a court order to send the county sheriff (usually) to the property to forcefully remove the tenants and their property to the curb.

In Michigan, you can do an eviction for cause or no cause, one of the cause evictions, is so that you can rent or sell to a family member here. As if you needed any more reasons to do an eviction, get er done, and if they threaten you call the police every time, and if they try to extract something that the law doesnt allow, that is extortion, call the police then too. If they say they know how to slow it down, I would see that as extortion and make a stink of it.

No, your idea would stall an eviction.

Just evict them, why play stupid games?

The laws do NOT favor tenants, the owner has a superior bundle of rights. They only get the upper hand if you screw up.
