If you are under investigation by law enforcement...?

Postby hackett » Sun May 27, 2012 2:52 am

If you are under investigation by law enforcement for them suspecting you were looking for drugs on Craigslist but then you decided not to pursue it can they release that information to your employer if they found out where you worked. If this has ocurred what would be your legal rights? Could you sue? Keep in mind I only referring to being under investigation but you never actually comitted the crime. By the way I am in New Jersey.

What the hell. Why would you look for drugs on Craigslist. Who knows what some random stranger might have done to them.

You're looking for drugs so you did not break any laws. If you'd have bought drugs then you would have (or taken, possessed, etc). However for future reference know that police track youtube, facebook, craigslist, and other popular websites for people who do the same thing you do and post it to the internet. The police will not tell your company what you were doing, but they can question your employers about the incident and your actions at work, drug usage at work, computer access, and so on.

@Del - Your actually incorrect, our police departments internet crimes division actually does go on Facebook, Myspace, Craigslist, etc to look for local prostitution, drugs sales, photos of drug usage, etc. Just because you haven't heard of a department doing it does not mean it doesn't.

no if you are under investigation only then you are innocent until proven guilty. if they did release that information which they wouldn't you could sue for libel and slander as it is the police dept intent to cause malice.

They can question your employer about your actions and drug use on the job and ask if you were using a computer at work to look on Craigslist for drugs or if any one there know about your actions.

You see, that's asking them questions, not really telling them.

FBI or any other agency in the US do not investigate people on drugs on Craiglist only. They prefer much unorthodox way like if they sell/buy on the streets or buildings that would be appropriate not on the internet.

If the guy is under investigation, the FBI would subpoena you to appear in court. So that you already know that you are under investigation. But if there is no subpoena or any letter coming from those government office then you are NOT under investigation. Sue them for what? You are under investigation remember in your own written words? How then can you sue a government agency or institution for? And for what? On what charge or charges would you open up to sue them for? You got no idea huh?! You see suing is easy but for formally charging them for something is the hardest part because you practically do not know what to charge them.

Your legal rights is to answer their charges and clear your name. That is your legal rights and not to sue them for what they did to you. I think you need seminar on law enforcement and the legality of the law on your life.
