Illeagal Search And Seizure

Postby Gruddyeu » Fri Jun 13, 2014 10:27 pm

Ok,you sorta have to know a little bit of the story.  If someone was under drug investigation, and they got pulled over, and right away the officer asked the person to step out of the car immediately without asking for a drivers license and not announcing why he was pulled over then searched three times with out a warrant is that legal?  And if not, then can the state keep the vehicle that was pulled over?  By the way, the vehicle was searched twice without finding anything.  then they went back a third time with dogs.  There was also and informant involved who stated that the person had drugs.  But still, could they really search the car three times without a warrant?  Especially if the driver was legalally driving with a license, registration, and insurance?

Illeagal Search And Seizure

Sara,     Since you didn't mention what kind of "drug investigation" was going on it is difficult to answer your question.  That could mean a whole range of things.    The bottom line is that if illegal drugs were seized during any of these searches and the defendant believes that the search is illegal then he/she has the chance to supress that evidence at the time of trial.  Almost all drug cases involve a pre-trial suppression hearing if the drugs were seized as a result of a search.
