Im staying in a family member's home with no lease?

Postby orlondo100 » Sat Oct 29, 2011 9:20 am

My family moved to utah from calif in may of this year. Made a verbal agreement with a family member to stay in their rental home, pay half the rent & help them slowly make upgrades to the home because they could not do it all at once. 5 days ago we received a call saying we had to be out by Septembers end. 2 days later we were told by the 15th of September, yesterday we were told by the 1st. Do they have the right to do this, 5 days to find a place & move? They all of a sudden say we are here illegally, & that they can come & go as they please with or without potential renters. What can we do to buy more time, we have no problem moving, but 5 days just isnt enough time. what is utah law?

It seems like in utah the landlord only has to give you 15 days notice.

Just because you have no written does not mean you can be kicked out on the street w/ no notice.

when a person stays under a particular roof for a somewhat extended stay there is an assumption that all parties have accepted the living arrangements. Throw in on top of that financial contributions and any judge would give the tenant the same rights as if a there existed a written document.

Since there was no written agreement, you can be forced to leave.

NO you are not there illegally & YES you have rights. You have a verbal month to month agreement which is legally binding on all parties and bound by state laws. They CANNOT come & go as they please. They must give you 24 hrs notice. 48 is required in some states. They have every right to show potential renters but they must still give you 24-48 hrs notice. It is illegal for them to kick you out with out proper notice. 30 days notice is required in most states. Shorter notice is only allowed if you have not paid the 1/2 of the rent as verbally agreed.

Inform them you DO have rights & will not leave until given proper notice.

EDIT: Yea it looks like it is 15 days in Utah. Assert your rights & insist on getting the 15 days you are entitled to.
