Improper backing on both drivers?

I was backing out into the street I live on which is really busy and I had already had my car turned. As I turned my head to put my car into drive the people across the street from me backed straight into my car. The cops barely talked to me about it and instead talked to the people across the street more. The people across the street kept saying we ran into each other. I was trying to tell the cops that I had already been backed into the street, but the kept saying it didn't matter because I could've been driving faster and there was no way to tell. Also when I backed out it was clear and I only turned my head to put my car in drive and when I turned around I saw there car right there and it was to late to move and they ran into me. Neither of us got tickets because it's my word against their's, but the cops wrote improper backing on both, so now I'm scared their insurance won't cover the damage to my car? Also I've never had a traffic violation or been in wreck even a fender bender, so is this going to make my insurance go up? Will it do any good to take them to small claims court?
