In ONTARIO (Canada) Can I use rental deposit as last month rent?

Postby fiacre68 » Sat Jul 14, 2012 8:48 pm

Before you jump to answers...
In most States (in US), it's illegal to use the deposit as a payment
for last month's rental.

The Question: In ONTARIO, CANADA... as per the Residential Tenancies Act
can I use the last month's deposit to pay the rent?

Before I occupy the house, landlord asked me to pay first & last month RENT.

This may or may not be considered as a "security deposit" ?

Can you please read the following two caluses before you answer? :-)

http://www.e-laws.gov.on.ca/html/statutes/english/elaws_statutes_06r17_e.htm#BK123
http://www.e-laws.gov.on.ca/html/statutes/english/elaws_statutes_06r17_e.htm#s106s10

I'm not a lawyer... that's why I needed to take an "opinion" about what are the above clauses/articles mean?

Thanks :)
