I checked the Indiana government web site and found that employers aren't required to give breaks nor meal periods. I was trying to explain this to my mom and she believes otherwise because she just received a class action lawsuit check from Wal-Mart for not giving their employees breaks. How could this be true if the Wal-Mart she worked for was located in Indiana? The law doesn't prescribe that the employers give their employees breaks. I checked the Federal Labor Laws as well and didn't find anything about breaks being required. Can someone help me out with this.
I suppose the lawsuit was based on where Wal-Mart is headquartered maybe? I do know that some states, such as Illinois, require employers to give breaks, while others don't. Why would my mom have received a check if she was working in Indiana which doesn't prescribe break periods of any sort?
